This Privacy Policy (“Policy”) describes the data collected (“Collected Data”) by or on behalf of Tobogo Therapies PLLC d/b/a TherapyWorks, TherapyWorks Autism Services PLLC, and/or TherapyWorks Management LLC (collectively “TherapyWorks,” “we,” “us,” or “our”) and its vendors through this website (“Site”), and how Collected Data is used and shared. If you have questions or concerns about this Policy, please contact us as set forth at the end of this Policy.

By using the Site, you agree on behalf of yourself and any organization that you represent (together, “you”) that you have read and understand this Policy. We may modify this Policy at any time. All changes will be effective immediately upon posting to the Site. Material changes will be conspicuously posted on the Site or otherwise communicated to you.

If you use this Site, you must comply with our Term of Use (“Terms”) found at https://therapyworks.com/terms-of-service/.

We Collect Data You Provide

Personal Information. You can visit the Site without submitting Personal Information. If you elect to provide information that personally identifies you (“Personal Information”) such as your name, email, mailing address, phone number, or birthdate, we will collect, use, and share it pursuant to this Policy and applicable law.  Personal Information is required to use certain Site features, for example, to submit an intake form and for us to respond to communications from you (e.g., when you contact us through our inquiries page).

Health and Insurance Information.  You can visit the Site without submitting Health and Insurance Information. If you elect to provide information about you or your child’s medical history and your insurance (“Health and Insurance Information”) such as your insurance company name, member identification number, group number, or medical history, we will collect, use, and share it pursuant to this Policy and applicable law.  Health and Insurance Information is required to submit an intake form and for us to respond with a quote of insurance coverage.

Employment Information.  When you apply to become a TherapyWorks therapist, we collect certain Personal Information from you, including your name, email address, phone number, and zip code.  We only use application information to evaluate employment applications.  If we select you to join the TherapyWorks team as a TherapyWorks therapist, you understand and agree that some of the information you provided will be made public through your public profile on our Site.

Client Account.  When you submit information through the Site requesting an appointment or asking us to verify or bill your insurance company, that information, including Personal Information and Health and Insurance Information, is used to populate your account in our practice management software (“Account“).  You must provide us your name, address, and phone number, client’s name, gender, date of birth, address, phone number, and email address in order to create an Account.

Payment Data. You can visit the Site without submitting Payment Data. If you elect to provide your credit card information (“Payment Data”) when submitting the intake form for payment of services such as your name, billing address, credit card number, card expiration date, and card verification value (“CVV”), we will collect and store it pursuant to this Policy.  Payment Data is requested in the intake form.  Credit and debit card data that is provided in the intake form is input to our third-party practice management software and run through their third-party payment processor Vantage or Stripe. We store your payment card’s last four digits and CVVs to facilitate future orders.  Although we do not collect your financial information, we may collect related Personal Information, such as your name and contact information, to facilitate the applicable transaction.

Marketing Communications; Opt Out. If you opt in to receive marketing communications from us, you must submit your name, email, mailing address, and/or phone number. We use this data to send you promotional and other electronic and hardcopy communications. We may use third-party providers to deliver communications to you. You may opt out of such emails by using the unsubscribe link in the email or contacting us at [email protected] with “Unsubscribe” in the subject line. To opt out of other communications (e.g., postal marketing and telemarketing), please contact us as set forth at the end of this Policy. Opting out of marketing communications does not opt you out of communications about your Account or transactions.

Data Automatically Collected

Non-Personal Information.  When we automatically collect data from your online activities, we sometimes collect information that does not personally identify you and is not readily available for that purpose (“Non-Personal Information“).  Unless required by applicable law, we will treat your internet protocol (“IP“) address and any location-related data as Non-Personal Information.

Account Activity. We may collect data about how you use (i) your Account, and (ii) the Site when you are logged into your Account.

Cookies, & Tracking Technologies. When you use the Site, we and our Site vendors use technologies such as cookies (i.e., small pieces of data stored on your device’s hard drive by your browser), web beacons, pixel tags, and similar technologies to automatically collect certain information about your online actives, such as IP addresses assigned to the computers and other devices you use, your internet service provider, device ID number, approximate geographic location, browser type, Site pages visited, websites you access before and after visiting the Site, and data related to how and when you use the Site (e.g., date and time stamps, clickstream data, and data about search terms and websites that direct you to the Site). We may combine this data with other Collected Data (including Personal Information) and data obtained from third parties.

The Site may use session, persistent, and flash cookies (local stored objects) to collect and store data about your preferences and navigation to, from, and on our Site. Session cookies are used to complete transactions and for other purposes such as counting visits to certain webpages. Session cookies are typically eliminated when you exit your browser. Persistent cookies may be stored for a set period of time (months or years) on your computer by your browser. When you log in, persistent cookies tell us if you have visited the Site before or if you are a new visitor.

Cookies may either be “first-party” or “third-party” cookies.  A first-party cookie allows your web browser to talk to the actual Site that you are visiting (i.e. this Site).  A third-party cookie allows your web browser to talk to a third-party website, such as the source of an ad that appears on the website you are visiting or a third-party analytics provider.  We do not have control over third-party cookies.  Third-party cookies are not governed by this Policy.

Most browsers automatically accept cookies. You can disable this function by changing your browser settings, but disabling cookies may impact your use and enjoyment of the Site.  Not all features or functions of the Site may work properly if you disable cookies.  You cannot disable all cookies, such as cookies that are essential to the functioning of the Site.

We treat information gathered by cookies as Non-Personal Information, unless otherwise required by applicable law.

Do Not Track Requests. we CURRENTLY do not honor “do not track” requests.

Analytics. We use certain analytics tools to help us improve the functionality of the Site.  We use Google Analytics to collect and process information about your use of the Site. Google sets cookies and then your web browser will automatically send Collected Data to Google. Google uses this data to provide us with reports that we use to improve the Site’s structure and content.

We may implement additional add-on services to Google Analytics, such as Demographics and Interest Reporting. Demographics and Interest Reporting uses Cookies to collect data about our Site traffic by tracking users across websites and across time to provide us with analytics on our user base.

Google may use the data it collects from the cookies it sets in accordance with Google’s Privacy Policy and Google’s page on “How Google uses data when you use our partners’ sites or apps.” You may download and install the Google Analytics Opt-out Browser Add-on for each web browser you use. Online Behavioral Advertising. We may use third-parties to provide internet-based advertising services. These services collect data about your interactions with the Site and other websites to send you targeted advertisements for goods and services. The data collected may be associated with your Personal Information. These advertisements may appear on the Site and on other websites and may be sent to you via email.

We use Google Ads to serve ads across various websites. Google uses cookies to collect data about your visits to the Site to generate targeted advertisements to you on other websites that you visit. To opt-out of this type of advertising by Google, to customize your ad preferences, or to limit Google’s collection or use of such data, visit and follow this link. Opting out will not affect your use of the Site.

To change your preferences with respect to certain online ads and to obtain more information about third-party ad networks and online behavioral advertising, visit the National Advertising Initiative Consumer opt-out page or the Digital Advertising Alliance Self-Regulatory Program. Changing your settings with individual browsers or ad networks will not necessarily carry over to other browsers or ad networks. As a result, depending on the opt-outs you request, you may occasionally still see our ads.

Social Media. We are active on social media, including Facebook, Instagram, and LinkedIn (“Social Media”). You may comment on Social Media regarding TherapyWorks and our products and services.

The Site allows you to connect and share data with Social Media. These features may require us to use cookies, plug-ins, and APIs provided by such Social Media to facilitate those communications and features.

Anything you post on Social Media is public information and may not be treated confidentially. We may post (or re-post) on the Site and our Social Media pages any comments or content that you post on our Social Media pages. You agree to hold TherapyWorks and its affiliates harmless and without liability for the results of any and all content you post on TherapyWorks’ Social Media.

Your use of Social Media is governed by the privacy policies and terms of the third parties that own and operate those websites and not by this Policy. We encourage you to review those policies and terms.

The Site may use advertising networks and services offered by Social Media to deliver advertising content. Use of these services requires Social Media to implement cookies or pixel tags to deliver ads to you while you access the Site.

How We Use Personal Information

In addition to those reasons we described elsewhere in this Policy, we may also use Personal Information for the purposes we describe below:

As Stated or Agreed to at the Point of Collection.  We may use Personal Information for the purposes stated or agreed-to (or as is obvious) at the point of collection.  For example, we use Personal Information to respond to your questions, comments, or complaints.  We use Personal Information to manage appointments and provide therapy to clients and their families.  We use Personal Information to verify your insurance coverage, submit and manage claims, and other insurance-related administration. We also use Personal Information as requested or consented to by you.

Administration.  We use Personal Information for administrative purposes, such as managing your Account, updating our online appointments calendar, facilitating transactions, to inform our business strategies, to understand the Site’s demographics and user preferences, for evaluating applications, and managing profiles.

Site Management.  We use Personal Information for Site management, such as troubleshooting problems, improving the content and functionality of the Site, statistical and other analyses of the Site, and to customize the Site to you and our users

Advertising.  We may use Personal Information to send you promotions or to perform targeted advertising, to notify you of new services, products or programs, to notify you of new features of our Site, to notify you of changes to our Terms or this Policy, and for other similar communications.

To Protect Our Rights.  We may use Personal Information to protect our legal rights or interests, or those of third parties, including to bring a legal action against you or anyone who may be causing harm to us, our Site, or to other users of the Site.

Disclosure of Personal Information

We do not sell, rent or lease Personal Information to any third party.  We may share Personal Information with the following parties, in compliance with applicable laws:

Employees and Affiliates.  We may share Personal Information with our employees and affiliates who have a need to know the information for our business purposes.  This includes sharing your child’s health information and other Personal Information within our therapy team.

Insurance Providers.  We share your insurance information and relevant health information with your insurance provider.  We share such information for the purpose of verifying coverage, requesting coverage, obtaining payment for services provided to you, settling claims and other payment and insurance administration activities.

Third-Party Service Providers.  We may share Personal Information with our third-party service providers, suppliers, consultants, agents, partners and representatives (collectively, “Service Providers“) that provide services for us, with whom we have contracted with to protect such Personal Information.

For example, we may share Personal Information with Service Providers to help us host and manage the Site; provide targeted advertising and other marketing; improve the content and functionality of the Site; perform data analysis and statistical analysis; troubleshoot problems with the Site; provide payment processing services; provide public relations; provide email services; provide data processing; and support or provide the security of the Site.

Government Officials / Law Enforcement.  We will cooperate with law enforcement and other governmental agencies, and may disclose Personal Information:  (i) if we believe in good faith we are legally required to disclose that Personal Information, (ii) if we are advised to disclose Personal Information by our legal counsel, or (iii) when necessary to identify, contact or bring a legal action against someone who may cause or be causing harm to, or interfering with the legal rights of, TherapyWorks or any other party.

Professional Advisors.  We may share Personal Information with our professional advisors, such as our attorneys, accountants, financial advisors and business advisors, in their capacity as advisors to TherapyWorks.

Change in Ownership.  In the event TherapyWorks is the subject of a change of control or in the event the Site changes ownership, in whole or in part, or in the event of a bankruptcy, receivership or a similar transaction, we may provide Personal Information to the subsequent owner(s).

Other.  We may share Personal Information with third parties when explicitly requested by or consented to by you, or for the purposes for which you disclosed the Personal Information to us as indicated at the time and point of the disclosure (or as was obvious at the time and point of disclosure).

Use and Disclosure of Non-Personal Information

TherapyWorks may collect, use, share, transfer and otherwise process Non-Personal Information received or created by TherapyWorks (or its Service Providers) for any business purposes in its sole discretion, in compliance with applicable laws. TherapyWorks is the sole and exclusive owner of any Non-Personal Information it collects or creates, including if it de-identifies any Personal Information so that it becomes Non-Personal Information.

Limited Collection of Sensitive Data

“Sensitive Data” is any data regarding your race or ethnicity, political opinions, religious or philosophical beliefs, trade union membership, physical or mental health information, or sexual orientation.  It is solely at your option to provide us with Sensitive Data, such as health information, although certain services may not be available to you if you do not provide us with certain information.  However, do not send us any additional Sensitive Data that we do not expressly ask you for.

We Do Not Intend to Collect Personal Information From Children Through the Site

This Site is not intended for use by anyone under the age of eighteen (18) years old or the age of majority in the state where they reside.  If you are under eighteen (18) years old or the age of majority where you live, please stop using this Site.

Data Security

We use commercially reasonable technical and organizational measures to help secure Personal Information against loss, misuse, and alteration appropriate to the type of Personal Information processed. If a breach of your Personal Information occurs, we will notify you of the breach if required under applicable law.

You understand that no data transmission over the internet or a mobile device can be guaranteed to be 100% secure. While we strive to protect Personal Information, we do not guarantee the security of Personal Information and you provide Personal Information at your own risk.

Access from Outside the United States

If you access the Site from outside the United States, please be aware that Collected Data may be transferred to, stored in, and processed in the United States. Certain governmental authorities may not consider the level of protection of Personal Information in the United States to be equivalent to that required by the in other jurisdictions.

Governing Law

Unless otherwise expressly required by the applicable law of your country of residence, this Policy is governed by the laws of the State of Illinois, United States, without regard to conflict of laws principles.  You agree to venue and personal jurisdiction exclusively in Cook County, Illinois with respect to any dispute arising under this Policy.

Third-Party Websites

The Site may link to, or be linked to, websites not controlled by us. We are not responsible for third-parties’ privacy policies or practices. This Policy does not apply to third-party websites or any data you provide to third parties. You should read the privacy policy for each website that you visit.
